Register of Orange
In early 1781, General Charles Cornwallis occupied Hillsborough re-imposing loyalist control of Orange County. Before long, Cornwallis and his army moved out, and as he left the Loyalists knew that the Revolutionaries would take back control.
Loyalist James Munro later stated in an affidavit that “when Lord Cornwallis gave sudden and unexpected orders for the movement of the army from Hillsborough,” he decided to seize, “the Records of the County with intention to hold them, in order to strengthen the influence of government until the contest should be decided.”
“I had all the records above mentioned privately buried underground in the woods along with my own bonds, books, and most valuable papers, with strict directions not to touch them until I should return; consequently they were suffered to remain in that situation so long, that when they were taken up, many of the books were found quite destroyed, and almost all my own papers rendered entirely useless.”
Of the several deed books which Munro buried, only one was salvaged, a book that was at that time known as Orange County Deed Book B and has since been renumbered Orange County Deed Book 1. Though there were thousands of real estate transactions in Orange County between its formation in 1752 and this incident in 1781, only a small fraction remain well documented in Orange County Deed Book 1.
However, in the 18th century, deeds had to be proved in court in order to be recorded in the deed books. The probate of a deed in court served the same purpose for which we now use a Notary Public – as proof that the deed was signed by the person whose signature appears on the deed. Deeds were typically proved either by having the grantor acknowledge his signature in court or if he was unavailable then one of the witnesses to the execution of the deed would testify to the genuineness of the signature.
In Colonial Orange County, it was the practice to record the probate of deeds in the minute book and/or a sort of notebook. That notebook, commonly referred to as the Register of Orange, included the names of the grantor, the grantee, the acreage conveyed and the name of the probate witness, but not the legal description.
My work here is an abstract of the Register of Orange. I have endeavored to copy each name as it appeared in the Register of Orange – though the modern spelling of many of these names is significantly different. It is also clear that in some cases, the person entering the information into the Register of Orange did a rather casual job of it, as will become clear from looking through this work.
Some of the deeds listed in the Register of Orange are the exact same deeds we find in Orange County Deed Book 1, others are grants of land from Earl Granville for which the original grant is to be found at the North Carolina State Archive in Raleigh. Still other deeds proved in the Register of Orange are deeds which were brought back in after 1781 and re-recorded – primarily in Orange County Deed Book 3. For each of these, I have listed the location of the deed or Granville grant.
For many other deeds listed below, there does not appear to be any surviving copy. For these deeds, I have attempted to supply evidence of what that deed likely was – by pointing to either prior or subsequent deeds for the same property.
Because Orange County was subdivided to create Chatham, Guilford and Caswell Counties, and two of those were further divided to create Randolph, Rockingham and Person Counties, it was necessary to look at early deeds from those six counties in addition to Orange. So you will find below places where I point to the deed books of those counties. There are also a few deeds I found in a few other counties which help to elucidate the deeds listed in the Register of Orange.
